Nondiscrimination and Accessibility Policy

Last Modified:

Introduction

This Nondiscrimination and Accessibility Policy (“Nondiscrimination Policy”) describes the terms and conditions under which Property Managers and Event Organizers describe and accommodate others based on protected characteristics to ensure fairness and safety for everyone involved. Together with our Terms of Service, this Nondiscrimination Policy is a contract entered into between You (“you,” “your,” “yours”) and Veneo Inc., a Delaware corporation (collectively, “we,” “our,” “us,” or “Veneo”). Any defined terms used but not defined herein have the meaning assigned to them in the Terms of Service.

1. Discrimination and Permitted Conduct.

  1. Protected Characteristics. We prohibit all Users, whether Event Organizer, Property Manager, Attendees, or someone else, from discriminating against others on the basis of a person’s race, religion, gender, age, familial status, marital status, ethnicity, national origin, sexual orientation, sex, gender identity, caste, pregnancy and related medical conditions, or disability.
  2. Minimum Age. No person under the age of 18 is permitted to be a User. Property Managers may, in their discretion, prohibit children under the age of 18 from being an Additional Event Organizer.
  3. Accurate Information. If applicable, Property Managers may include information about disability accommodations as amenities in the Listing, or provide additional information that may affect certain persons (for example, that the Venue is a walk-up with stairs only).
  4. Event Organizer Disclosures. Event Organizers may, in their sole discretion, provide information about themselves to a Property Manager in order to make a determination about whether the Venue is suitable for their needs. We strongly encourage Event Organizers to provide such information at the time of Booking.

2. Prohibited Conduct

  1. Refusal of Service or Differential Treatment. Users may not treat other Users differently, discourage, or deny services to someone because of the characteristics or any perception that a person has such a characteristic, including declining or cancelling a Booking, indicating a preference for or against a specific kind or type of Event Organizer, or charging any additional or different fees.
  2. Determination by Event Organizer. While Property Managers may provide certain information about a Venue or Listing, the suitability of any particular Venue is determined by the Event Organizer, including whether a Venue will meet the needs of an Event Organizer with disabilities.
  3. Discriminatory Language. No User or affiliate thereof, including third-parties accessing or using a Venue during a Booking (the actions of which are the responsibility of the User to whom they are associated), may use any language that calls for exclusion, segregation of, violence towards, demeans, insults, stereotypes, or seeks to convey a person’s inferiority because of a protected characteristic. This includes the usage of slurs, negative associations, intentionally referring to a transgender individual by their pre-transition name while knowing of their preferred name, intentional misgendering, microaggressions, and any other form of hateful speech.
  4. Discriminatory Symbols. No User or affiliate thereof, including Attendees or third-parties accessing or using a Venue during a Booking (the actions of which are the responsibility of the User to whom they are associated), may display symbols, objects, logos, slogans, or images that are hateful, stereotype people because of a protected characteristic, convey a discriminatory meaning, or are intentionally unwelcoming or divisive. This includes images depicting discriminatory or racist symbols (including coded symbols), leaders of hate groups, or stereotypes, such as the German Reich and National Flag or similar depiction (but not the swastika as used with spiritual and auspicious meanings in Hinduism, Buddhism, and Jainism) and the Confederate Battle Flag or similar depiction.

3. Accommodations.

  1. Accommodations and the ADA. This Nondiscrimination Policy includes suggestions for conduct of both Event Organizers and Property Managers. Veneo is not a party to any Booking, which is made strictly between the Event Organizer and Property Manager, and accordingly, we are not responsible for any Venue or individual’s behavior that may violate the Americans with Disabilities Act or any other applicable law. We strongly recommend that Property Managers familiarize themselves with the Americans with Disabilities Act.
  2. Service Animals. During a Booking, Event Organizers and Attendees may be accompanied by a service animal, which is an animal (usually a dog, but not always) that is trained to do work or perform tasks for a person with disabilities. Service animals are specialized medical equipment and are not pets. Property Managers cannot prohibit a service animal, even if the Property Manager does not permit pets. Property Managers may prohibit emotional support animals unless otherwise required to permit them by applicable laws. An emotional support animal is an animal that provides emotional support or assistance to a person to help manage the symptoms or effects of their disability. Event Organizers are not required to provide documentation that an animal is a service animal, and Property Managers should not ask for or require such information. Event Organizers do need to disclose the presence of a service animal in advance, but are strongly encouraged to do so at the time of Booking.
  3. Additional Reasonable Accommodations. An Event Organizer with accessibility needs may request a reasonable adjustment to aid the Event Organizer’s ability to access a Venue. We encourage Event Organizers to make these requests at the time of Booking, but in any event, no less than a reasonable time in advance. Property Managers may propose a reasonable alternative, and may refuse an unreasonable or unattainable request, including requests that pose a significant risk to the health or safety of the Property Manager or others, fundamentally change the nature of a Venue, require structural modification to a Venue that is not easily accomplished without much difficulty or expense, require the Property Manager to take on added responsibilities that cause significant difficulty or expense, ask a Property Manager to violate applicable laws or the Terms of Service.
